Terms and conditions
1.3. The rental agreement comes into effect with the signature of the landlord. 2. Withdrawal and handover of the apartment 2.1. The apartment can be purchased at the beginning of the tenancy by appointment. 2.2. Should the entry be made on weekends or after 17.30 clock, can, after appropriate consultation, the keys can be handed over previously. 3. Renewal of the tenancy agreement 3.1. The lease can be extended with a announcement period of 14 days prior to the termination of the lease. The rental extension is concluded only when this has been confirmed in writing to the tenant by the landlord. 3.2. Price increases are reserved for extensions. 4. Termination 4.1. During the term of the lease time (cf. par. 1) are regular denunciations of the landlord or the tenant's impossible. 4.2. Does the tenant want to terminate the lease before the agreed fixed rental period (cf. par. 1), is only permitted if a suitable tenant is constituted. The rental agreement between tenant and landlord terminates on the date on which the next tenant is willing to enter into the lease. 4.3. If a permanent lease is to be completed subject to the statutory notice provisions of § 549 para. 2 No. 2 BGB. 4.4. The landlord may, in accordance with legal provisions, terminate the rental agreement without notice if the tenant fails to fulfill its contractual obligations (eg. payments in arrears, in breach of contract use, unauthorized release to third parties, etc.). 5. Rental and services 5.1. The rent and all services have to be paid monthly in advance, no later than 1st working day of the month to the landlord by bank transfer (the transfer costs borne by the tenant) or cash in Euro. 5.2. All prices are inclusive legal VAT. 5.3. The VAT is shown separately from the landlord. 5.4. If the currently valid value added tax rate of 19% changes, the landlord is entitled to adjust prices for rent and services. 5.5. The tenant will be charged a flat rate for final cleaning. The price for this is clear from the current price list. 5.6. A list of additional services can be found in the appendix. 6. Deposit 6.2. The amount of the deposit at a short-term rental of less than one month is one week's rent. 6.3. The amount of the deposit at a long term lease from one month is one month's rent. 6.4. The deposit is to be transferred back within 30 days after termination of the lease to an account wich to be announced by the tenant, unless it was claimed. 7. Temporary use, use of rental property 7.1. The tenant rents for temporary use. The minimum rental period is 5 days. 7.3. No pets allowed. 7.4. The apartment is a non-smoking apartment. If it is smoked anyway in the apartment, is an increased cleaning fee of at least € 500.- charged to the tenant, so the next tenant may recover in a pleasant living environment. 7.5. A profession in the apartment is then subject to authorization, if thereby affecting substantial interests of the neighbors or the landlord. Telecommuting and non-disruptive activities are allowed without a permit. 7.6. The tenant is entitled to use water, heat and electricity within the normal range. The cost of which is included in the rent. The tenant undertakes to avoid unnecessary consumption of energy and water. 7.7. The fees for waste disposal are included in the rent. It will apply to the disposal of domestic waste in the usual quantity. The tenant is obliged to avoid unnecessary waste. 7.8. For the leased property shall be three keys given to the tenant at the handover. A house key, a door key and a mailbox key, returned to the landlord at the expiry of the lease. Additional keys can be left to the tenant on bail. 8. Maintenance of the rental property 8.2. The tenant has to treat the apartment with care. 8.3. The tenant is liable to the landlord for damages caused by violations of the duty of care or reporting, especially if the rooms are inadequately ventilated, cleaned, heated or not sufficient protected against frost. 8.4. The inventory should not be removed. 9. Use of equipment 9.1. The houshold and entertainment equipment wich is present in the apartment, is available to the tenant for dispose. All equipment used at own risk of the tenant. 9.2. The equipment provided by the owner has to be treated carefully and gently. 9.3. The tenant undertakes to respect the instructions for use, wich are made available by the landlord. He is entitled only to an intended use of the devices in compliance with all manufacturers' specifications. 9.4. The tenant is liable for all damages, wich may occur during lease, if they are not covered by manufacturers warranty. 10. Telephone and Internet 10.1. The tenant may use the telephone and internet in the apartment. The landlord is not liable, if by network congestion or other reasons located in the responsibility of the telecommunications service provider, no connection is made. 10.2. The tenant has to ensure that the Internet is used only within the range permitted by law. 10.3. The telephone rental and call charges to German fixed lines are included in the rent. 10.4. Connection costs and foreign mobile lines are charged to the tenant as well as any use of fee data and communications services in the amount of actual charge. Invoicing these costs shall be made within four weeks after the landlord has received the billing of the telecommunications provider. 10.5. Upon request, a telephone flat rate for international calls to 50 countries (see country list in appendix) will be made available to the tenant. This additional service can be booked for a stay of at least 3 months. The foreign flat rate is provided to the tenant in accordance with the valid price list. 11. Entering the rental property by the landlord 11.1. The owner and / or his agent may enter the property for important reasons after timely notice. 11.2. In the absence of the tenant of more than two weeks he has to close all water intakes and to provide a key to the property management of the landlord. 12. Returne upon termination of the lease term 12.1. Upon termination of the lease term the apartment is to surrender in the same condition as to rental before 11.30 clock. Should the apartment not been handed over in proper condition until said time, will be a daily fee of at least € 250.- payable. 12.2. When handing over the apartment, return all previously handed over keys to the landlord. 12.3. The tenant has to compensate the owner any damage to the apartment, where the tenant is responsible for the damage. 13. Severability clause 13.1. If any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. In place of the ineffective provision shall enter an arrangement which economically and legally inoperative comes closest. 14. Jurisdiction and Applicable Law 14.2. Only German law applies.
